1. Acceptance of Terms

By downloading, installing, or using FoodPic ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the App.

If you do not agree to these Terms, you must not use FoodPic. These Terms constitute a legally binding agreement between you and Viga.app ("we", "us", "our").

2. Description of Service

FoodPic is a mobile application that allows users to:

• Photograph meals for AI-powered nutritional analysis
• Track daily calorie and macronutrient intake
• Maintain a personal food diary
• View personalized health recommendations
• Monitor nutrition trends and progress over time

3. Eligibility

You must be at least 13 years old to use FoodPic. If you are under 18, you may use the App only with the consent of a parent or legal guardian.

By creating an account, you represent that you meet these age requirements and that all information you provide is accurate.

4. Your Account

4.1 Registration

You may sign in using your Google account. You are responsible for maintaining the security of your account and for all activities that occur under it.

4.2 Account Responsibility

• Keep your login credentials secure
• Notify us immediately of any unauthorized access at admin@viga.app
• Do not share your account with others
• Do not create multiple accounts to circumvent restrictions

4.3 Account Termination

You may delete your account at any time from within the app (Profile → Settings → Delete Account) or by submitting a request at this page. We may suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You may use FoodPic to:

• Track your own personal food intake and nutrition
• Set and monitor your personal health goals
• Share your progress with healthcare professionals for your own benefit

You may NOT use FoodPic to:

• Attempt to gain unauthorized access to our systems
• Reverse-engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Upload harmful, offensive, or illegal content
• Scrape, copy, or redistribute App content for commercial purposes
• Impersonate another person or entity
• Circumvent subscription limitations through unauthorized means

6. Subscriptions & Payments

6.1 Free & Premium Tiers

FoodPic offers a free tier with limited features and a premium subscription that unlocks additional functionality. Subscription plans, pricing, and included features are displayed in the App.

6.2 Billing

Premium subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to their respective billing policies and terms.

6.3 Cancellation & Refunds

• Cancel your subscription anytime through your device's app store account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are governed by Apple App Store or Google Play policies
• We do not offer refunds directly; please contact Apple or Google for refund requests

6.4 Price Changes

We reserve the right to change subscription prices. We will provide advance notice of any price changes through the App or email.

7. Intellectual Property

7.1 Our Content

The FoodPic App, including its design, code, graphics, and content (excluding your personal data), is owned by Viga.app and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7.2 Your Content

You retain ownership of the photos and data you upload to FoodPic. By using the App, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the App's services to you.

8. AI & Nutritional Accuracy

FoodPic uses artificial intelligence (Google Gemini) to analyze food photos and estimate nutritional content. You acknowledge that:

• AI-generated nutritional data is an estimate and may not be perfectly accurate
• Accuracy depends on photo quality, food presentation, and portion visibility
• FoodPic is a wellness tracking tool, not a medical device
• Decisions about diet, medication, or treatment should be made with qualified healthcare professionals
• You use nutritional data at your own discretion and risk

9. Privacy

Your use of FoodPic is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we handle your personal data.

10. Disclaimers & Limitation of Liability

10.1 No Medical Advice

FoodPic is not a medical app. Content in the App is for informational and wellness purposes only. Do not use FoodPic as a substitute for professional medical advice, diagnosis, or treatment.

10.2 "As Is" Service

FoodPic is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely accurate.

10.3 Limitation of Liability

To the maximum extent permitted by applicable law, Viga.app shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of FoodPic, including but not limited to health outcomes based on App data.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue FoodPic (or any part of it) at any time with or without notice. We will not be liable to you for any modification, suspension, or discontinuation of the service.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Display a notification within the App
• Email registered users for significant changes

Your continued use of FoodPic after any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of FoodPic shall be resolved through good-faith negotiation or, where required, through binding arbitration.
